Resolution of Disputes
If a dispute becomes serious enough to require professional or legal advice, MCS will take over. Our capable team will liase with property manager, professionals and Landlord or Freeholder to resolve the dispute efficiently, leaving property managers free to concentrate on the day-to-day management of a building.
Arrears Chasing
Prompt service charge payment is essential for effective property maintenance. We provide a vital role here, by taking over the arrears chasing procedure if solicitors’ involvement becomes necessary.
Our standard property management arrears chasing policy gives the lessee ample opportunity to make good the missing payment, avoiding legal action in the majority of cases. If MCS and solicitors do become involved, all fees are payable by the defaulting lessee.
Licences to Alter
Lessees wishing to conduct any form of work in their flat should contact MCS to find whether proposed works require a Licence to Alter, i.e. consent from the Landlord. If so, MCS will liase with all relevant parties to facilitate the Licence’s generation.
- As a general rule, any work that alters the fundamental nature of the flat as laid out in the Lease, or that could have an impact on the rest of the building, requires a License to Alter. Not obtaining one may contravene the lease, making future sale of the flat very difficult.
- Lessees should contact MCS a minimum of two months in advance of the proposed works to allow time for processing the Licence. If no Licence is required, MCS should still be notified of any work, so that they can inform porters and other lessees as necessary.
- Associated costs are payable by the lessee applying for the Licence, as per their lease.
Licence to Sublet
Some leases state that the Landlord must grant permission before an individual flat is sublet. If so, MCS will administer on behalf of the client, with associated costs passed to the lessee requiring the Licence. At least four weeks should be allowed for processing the Licence.
Licence to Keep Pets
Most leases require a Licence to keep pets in the building. Obtaining this licence can involve many complicating factors, sometimes taking a month or more to resolve. MCS’s experienced team can ease the process by taking over the Licence’s administration, with costs payable by the lessee.
Solicitors’ Enquiries
MCS will reply to Solicitors’ Enquiries on behalf of purchasers in buildings under MCS’s management. These enquiries relate to the management of the building, with typical questions being the level of service charge and any planned major works.
The fee for this, £200/£250 plus VAT, is paid by the property’s vendor. MCS will answer routine Solicitors’ Enquiries within five days of receipt of payment.
Deeds of Variation
A Deed of Variation is required when an individual lease has to be amended in some way, for example a change to any service apportionment. All deeds of variation must be approved by more than the majority of lessees. MCS will liase with all relevant parties to complete the deed’s sometimes complicated production as efficiently as possible. Administration and solicitors’ costs are passed to the lessee.
Ground Rent Collection
Ground Rent must be demanded separately from the service charge, a minimum of 30 days in advance of the due date, in accordance with the Commonhold and Leasehold Reform Act 2002. MCS will collect Ground Rent for an agreed fee.
Lessee Handbooks
Lessee handbooks clearly set out a building’s regulations and lessees’ obligations. These can be difficult to decipher from the legalese of contracts and other documents, yet if all lessees know the rules the building is a much more pleasant place to live, and disputes can be avoided.
