Tenancy Deposit Scheme
Tenancy deposit law was introduced on 6th April 2007 and provides protection for tenants. The scheme protects all Assured Shorthold Tenancies in England and Wales (covering most tenancies since 1997). All tenancies starting from this date must register the deposit, Moretons will arrange for this to be done on your behalf once the tenancy has started.
Landlords Responsibilities
Moretons agree to take on the Landlord’s property on the understanding that the following conditions have been met:
Sub-Letting
If the Landlord is a tenant of a lessee (i.e. leasehold tenure) it is essential that:-
a) The intended furnished letting is permitted by your Lease.
b) That the intended furnished letting is for a period expiring prior to the termination of your Lease.
c) That your landlord’s written permission (if required) is obtained for sub-letting.
Development Permission
a) If the property has been redeveloped in recent years the planning consent issued by the Local Authority will have stipulated how the property can be used post redevelopment. It is the Landlord’s responsibility to check that the necessary consents are in order to rent out the property.
b) The Landlord and not Moretons will remain solely responsible for any breach of this obligation and will indemnify Moretons against any loss arising in any way from such breach.
Mortgages
a) Where the property to be let is subject to a mortgage, permission is normally required from the mortgagee to let or sublet the property furnished. It is the Landlord’s responsibility to ensure that this is done and Moretons accept no responsibility. Please note that applying for permission after a tenant has been found could prejudice the letting.
Insurance
a) The Landlord must ensure that the building and contents insurance cover is adequate and that the policy covers furnished lettings, please note that many household policies do not do so.
Energy performance certificate (EPC)
a) EPC’s are valid for 10 years and can be reused as many times as required within
that period. It is not necessary to commission a new EPC each time there is a change of tenant although you may commission EPC’s for these properties at any time to prepare for a change in tenant.
b) The EPC provides prospective tenants with information about how energy efficient
a property is. An EPC is not required for any property that was occupied before 1st October 2008 and which continues to be occupied after that date by the same tenant.
c) Moretons can arrange for an EPC or we can recommend a company to do this, we
will need to have a valid certificate before we can begin marketing the property.
Note: Moretons cannot be held liable for any difficulties arising as a result of failure to observe the above.
